Clayground Studio Membership Agreement

1. Studio Description

Clayground at 312 Court Street is a pottery studio dedicated to fostering creativity and artistic development for members in our community. We aim to provide a welcoming environment where members feel supported by a close-knit operation. Membership provides access to the studio and its amenities, including pottery wheels, workspaces, and additional services as described below. 


2. Membership Eligibility

Membership is available to individuals aged 18 and older. Minors may join with written parental consent and supervision. The studio reserves the right to verify eligibility and may reject applications at its discretion based on non-compliance with eligibility requirements, prior violation of studio rules, or studio capacity.


3. Individual Membership Policy

Memberships are strictly individual and cannot be shared or transferred. Members are required to present identification upon request to access studio facilities. Any attempt to share membership benefits with non-members will result in immediate suspension or termination of membership without a refund.


4. Membership Fees

Monthly membership dues must be paid in full prior to the commencement of the term. Fees for clay and firing services are separate from membership dues and are subject to change with prior notice. Detailed costs are as follows:


  • Monthly Membership: Published on our member site and subject to change

  • Clay Fee: Published on our member site and subject to change

  • Firing Fee: Published on our member site and subject to change


Monthly memberships automatically renew on the same date each month based on the initial enrollment date. If the original start date falls on the 29th, 30th, or 31st, the renewal date will adjust to the last valid day of subsequent months. The studio will notify members of any changes in billing cycles due to these adjustments.


5. Price Adjustments

Clayground reserves the right to adjust membership fees annually or as deemed necessary, reflecting changes in the Consumer Price Index (CPI) or other relevant economic factors. Members will receive a minimum of 30 days’ notice prior to any fee adjustments. Continued membership following a fee adjustment constitutes acceptance of the new fees.


6. Cancellation Policy

Members may terminate their membership at any time by providing written notification to the studio. Termination will be effective at the end of the current billing cycle, and no refunds will be issued for the remaining period. If Clayground initiates cancellation, a prorated refund for any unused portion of the membership term will be provided. The studio reserves the right to terminate memberships for violations of studio policies or disruptive behavior, with or without notice.


7. Studio Access & Closures

Members have access to the studio during regular operating hours, which are posted on the studio’s website and at the entrance. The studio reserves the right to alter these hours for special events, classes, or maintenance. In cases of unforeseen events requiring closure, the studio will notify members as soon as possible.


8. Equipment Use and Restrictions

Members are entitled to use all studio equipment with the exception of kilns and pug mills, which may only be operated by trained staff. Members must adhere to all posted guidelines for equipment use and report any malfunctions or damage immediately. Personal materials should be clearly labeled and stored in designated areas. The studio is not liable for personal items lost or damaged on the premises.


9. Studio Rules and Atmosphere

The following studio policies are designed to promote a welcoming and productive studio environment. Violation may lead to suspension or termination of membership without refund at the studio’s discretion.


  • No Smoking: Smoking is prohibited inside the studio and on the premises.

  • No Harassment: All members must maintain respectful conduct towards others. Any form of harassment will not be tolerated and may result in immediate membership termination.

  • Noise Control: Members may listen to music only with headphones to maintain a productive environment.

  • Food and Drink: Consumption is restricted to designated areas to prevent contamination of workspaces and materials.

  • Cleanliness: Members must clean their workspaces after use, including the disposal of clay scraps and proper tool storage. Please do not use the bathroom sink to clean clay.

  • Clay Usage: Only clay types specified on our member site may be fired in the studio; other clay types are not permitted without express prior approval.

  • Tool Usage: Studio tools should be used responsibly and returned to their designated places after use. Members are responsible for any damage caused by misuse.

  • Personal Belongings: Items should be stored properly and kept clear of communal spaces.

  • Kiln and Pug Mill Operation: Restricted to designated staff; members must not attempt to operate these without authorization.

  • Shared Materials: Use of studio materials should comply with studio protocols to ensure fair access for all members.

  • Fire Safety: Comply with posted signs and follow staff instructions, including superseding guidance, in case of any emergencies.


10. Safety and Liability

Members assume all risks associated with studio activities, including potential injuries from equipment use. The studio is not responsible for any personal injury or property loss. Members agree to indemnify and hold Clayground harmless from any claims arising from participation in studio activities. It is recommended that members maintain personal health insurance.


11. Security and Privacy

Security cameras may be in operation throughout the studio and to ensure safety and security. By entering the studio, members consent to being recorded and acknowledge that these recordings are used for security purposes only.


12. Clayground Marketplace

The Clayground Marketplace is an online platform that allows members to showcase and sell their pottery creations. By participating in the marketplace, members agree to the additional following terms:


  • Listing and Sales: Members can list their pottery pieces for sale through the Clayground website. Each listing must comply with the studio’s guidelines, including accurate descriptions, pricing, and high-quality images. The studio reserves the right to review and approve all listings before they are posted.

  • Commission: Clayground will retain a 10% commission on all sales made through the marketplace. This fee covers administrative costs, website maintenance, and promotional activities aimed at increasing visibility and sales.

  • Payment Processing: Sales transactions are processed through a secure payment system. Funds, minus the commission, will be disbursed to the member’s designated account within a specified timeframe after the sale is finalized.

  • Intellectual Property: Members retain all intellectual property rights to their work. However, by listing items on the Clayground Marketplace, members grant the studio a non-exclusive, royalty-free license to use images of their work for marketing and promotional purposes.

  • Liability and Indemnity: Clayground is not liable for any disputes arising from sales transactions, including but not limited to, issues related to product quality, delivery, or customer satisfaction. Members agree to indemnify and hold the studio harmless from any claims or damages related to their participation in the marketplace.

  • Product Removal: The studio reserves the right to refuse or remove any product listing at its discretion. Reasons for removal may include, but are not limited to, non-compliance with listing guidelines, customer complaints, or inappropriate content.

  • Termination: Members may withdraw from the marketplace at any time by removing their listings. Clayground also reserves the right to terminate a member’s participation in the marketplace for violations of these terms or any other studio policies.


13. Indemnity

Members agree to indemnify and hold harmless Clayground, its employees, and affiliates from any claims, damages, or expenses arising from their use of the studio or violation of this agreement.


14. Jurisdiction

This agreement shall be governed by the laws of the State of New York. Any disputes arising under this agreement shall be resolved in the courts located in New York County.


15. Completeness

This agreement constitutes the entire understanding between the parties regarding membership at Clayground and supersedes all prior agreements or understandings.
